    Weatherford reported on behalf of Solutions 2012 the task force appointed by State Bar President Bob Black to study and make recommendations regarding the issue of assisting indigent pro se litigants Prior to the meeting the SCAC received a detailed report of more than 80 defects in the proposed forms The report was prepared by the Family Law Section Texas Family Law Foundation Texas Chapter of the American Academy of Matrimonial Lawyers and the Texas Academy of Family Law Specialists It was reviewed and endorsed by three current and former family law judges and 13 Board Certified Family Law Specialists The defects included constitutional violations conflicts with the Family Code and the Civil Practice and Remedies Code internally conflicting provisions between the instructions and the forms as well as the forms themselves Stewart Gagnon of Houston who proposed and chaired the task force that developed the proposed forms led the defense of them The SCAC s two day meeting allowed a clear demonstration that the nine month effort by the task force failed to provide forms that would be legally sufficient and produce enforceable results Members of the SCAC raised many questions about the forms Much of the discussion focused on the degree to which forms must adhere to statutes enacted by the Legislature and how far the wording instructions and content of any forms could deviate from the terminology of the Family Code Board Certified Family Law Specialist Richard Orsinger San Antonio and Dallas presented a report of the SCAC subcommittee that he chaired which also recognized numerous problems with the forms and proposed that their use be strictly limited if the Court decides to approve the use of any forms Patricia Baca a Tarrant County family lawyer testified against the forms pointing out questions of whether judicial immunity

    in Friendswood 04 Apr 2012 10 38 AM Richard Myers Administrator I would like to offer a few comments on the excellent ACR program recently held at the Friendswood Mediation Center First I want to thank Jeff Kilgore for putting together and serving on the presentation panel with Judge Stephen Baker and Bill De La Garza The panel introduced the subject of pro se litigants in divorce and facilitating their access to the legal process through the use of promulgated forms The panel s perspective seemed to be that developing forms for use by pro se parties was undesirable The panel did not seem prepared to offer less noxious alternatives After 33 years in the practice of law I feel safe in opining that relying on forms would be putting a band aid on a bazooka wound The legal system has become a secular religion which insulates and protects itself with an arcane set of procedures and processes which can only truly be navigated effectively by lawyers The panel discussion reflected this reality focusing almost entirely on questions of attorney involvement For example can a mediator refer a client to an attorney can an attorney un bundle her services to

    pro se parties in mediation Some parties agree to use one attorney to finalize the decree some want the decree reviewed by a separate attorney some do not know what to do Since an attorney can only represent one party there was a discussion on whether a mediator could refer a party to a specific attorney or even 3 4 attorneys Who pays for the attorney and whose attorney are they These are matters that can negotiated in mediation The discussion started with what about the parties that cannot afford an attorney Can an attorney un bundle services and prepare just the decree and wage withholding orders and will they Can attorneys charge a reduced fee for preparing the decree and ancillary closing documents Can attorneys commit to preparing a pro bono decree and ancillary documents when needed Is it improper for a mediator to suggest an attorney Can a Bar Association or Family Bar Association create a list of attorneys that are willing to provide an unbundled services just to prepare the decree and ancillary documents At reduced rates depending on the needs of the parties If an attorney provides Pro bono services and charges nothing are they protected whether the file is generated through an indigent program like Lone Star Legal Aid or not Should forms for filing family law matters be provided at the Family Clerk Desk What education should be provided to pro se parties in understanding the forms being provided comments questions answers or move to action would be appreciated Jeff Kilgore Mediator Lawyer Arbitrator 305 21st Street Suite 241 Galveston Texas 77550 TMCA Credentialed Distinguished Mediator Add comment Comments 03 Apr 2012 9 10 AM John Kenyon I think that this is an area where lawyers mediators and judges can get themselves in trouble
