    Historic Production air intake He felt that the proposed rule wording was too vague and questioned how the aspect of no performance increasing devices would could be policed Gauze air filters are listed as acceptable yet advertising for K N gauze air filters claims the filters provide a performance increase He asked to strike the words no performance devices be added and to be more specific as to what would be allowed Hatten responded that rules are written to convey an intent and it is not possible to include an item by item list of what is and is not acceptable within each and every rule in the AHRMA Handbook Mork stated that the intent of the class is to provide a low cost entry level arena for beginning road racers Breckon opined that the number and type of machine modifications in the Historic Production class is beginning to get out of hand and that AHRMA wants to be responsive to the needs of this class Wells proposed a Rookie of the Year award for AHRMA Road Racing with the prize being a paid road race school entry or some other prize to be determined The Board agreed and Janiec asked the Awards Committee to work with Wells to determine the specific criteria and award that would go to the recipient Ginger Hilgenberg stated that direct emailing could be a low cost effective tool in the promotion of AHRMA activities While not all members use email daily most do have some sort of email access Janiec asked for and received no other member comments at 11 00am The meeting continued in open session Lamberth continued his Executive Director s report with a review of the proposed 2011 Road Racing schedule There was discussion regarding the financial viability of a new event near Dallas Texas Lamberth said he expected the event to break even the first year while building toward a more profitable future there is potential for event sponsorship When asked the number of road race members in the area Tim Lile stated that there are 160 in Texas and 50 in Oklahoma A discussion of the off road schedule ensued Bentley asked why Vintage Motocross often runs on the Saturday of a race weekend with Post Vintage Motocross racing on Sunday he felt it would be preferable to have VMX on Sundays Lamberth stated that in some cases the promoter has a preference and that AHRMA does have input At some tracks the conditions deteriorate during the weekend so VMX is better suited to racing on Saturday while other tracks can be satisfactorily groomed overnight which would allow VMX to run on Sunday Off Road Coordinator Guidi said he ll help the individual promoters determine which day is best for each discipline Lamberth reviewed the tentative first draft of AHRMA s 2011 Operating Budget Lamberth discussed the relevant notes of explanation before moving on to the actual budget Lamberth stressed that before the budget could be properly discussed certain

    a lawsuit filed in the United States District Court Eastern District of New York by Mr Robert Iannucci Team Obsolete and five riders When we filed our claim with our insurance carrier Reliance we discovered it was insolvent in the largest insurance bankruptcy of its type in the country AHRMA was able to secure coverage from the Wisconsin insurance insolvency fund that covered 300 000 It was anticipated this would cover the cost of the case Unfortunately the costs of defending the action in New York were staggering and well exceeded the estimates of our legal team The fund was exhausted in the summer of 2006 during the discovery portion of the case and subsequent defense exhausted AHRMA s financial resources In order to preserve our remaining resources maintain the integrity of the association and further the interests of our members AHRMA petitioned for chapter 11 reorganization in November 2006 in the US Bankruptcy Court Middle District of Tennessee in Nashville The filing was as the direct result of indebtedness resulting from our defense of the lawsuit The filing of the petition stayed the lawsuit in the New York district court pending reorganization The US Attorney and court reviewed our financial position at the start of the bankruptcy and determined that we were a strong going concern other than the debt incurred from the litigation defense As a part of the bankruptcy process AHRMA moved to have the value of any potential claim by Team Obsolete Mr Iannucci and the other plaintiffs to be estimated in the bankruptcy court This motion was upheld at a critical hearing in January 2007 Subsequently AHRMA and all the plaintiffs reached a settlement documented in a bankruptcy court Agreed Order agreeing not to pursue or assert any claims against each other for any past

    AHRMA reorganization and litigation Bankruptcy memorandum Federal court s BEARS decision Open letter to AHRMA members Transcript of the Judge s decision from the January 31 2007 hearing Posted 2 1 07 Chapter 11 update AHRMA and Team Obsolete met in U S Bankruptcy Court Middle District Tennessee on Jan 31 to argue AHRMA s motion to estimate Team Obsolete s claim in their lawsuit Team Obsolete is opposing motions in order to return the case to federal district court in New York Arguments were heard on motions from both sides in the bankruptcy court The judge has taken this under advisement and will render a decision by phone conference early next week Members will be notified as soon as we know anything Additional information about the Team Obsolete litigation and AHRMA reorganization can be found below Posted 2 7 07 Court sustains AHRMA motion to estimate Team Obsolete claim The Bankruptcy Court for the Middle District of Tennessee Judge Marian Harrison today issued its ruling on several pending motions in the AHRMA Chapter 11 case Based on the hearing held on Jan 31 and the entire record the court denied the Team Obsolete parties motion seeking transfer of venue of the bankruptcy case to New York The Court further denied their motions for abstention or suspension which would have allowed the New York District Court action to continue to fix and liquidate whatever claim the Team Obsolete parties might have against AHRMA Finally the Court sustained AHRMA s motion to estimate the claim in the bankruptcy case A conference to discuss and determine the procedures for estimating the claim has been set for March 26 This is a first major step in the process to define the TO claim if any set our reorganization plan to pay our creditors and emerge from Chapter 11 said AHRMA Chairman Dave Janiec Posted 4 3 07 Court determines procedures for claims estimation The Bankruptcy Court for the Middle District of Tennessee held a pretrial conference on March 26 for the purpose of determining the procedures to be applied in the estimation of the claims of Team Obsolete et al The Court determined that the parties would submit Proposed Findings of Fact and Conclusions of Law for the Purpose of Claims Estimation The hearing on this portion of the claims estimation process is currently scheduled to take place in June In this phase of the claims estimation process the Court will be determining what if any liability exists as to each of the claims of Team Obsolete On March 27 the Bankruptcy Court denied Team Obsolete s Motion for Reference to Mediation without prejudice as to Team Obsolete filing another motion after the issues have been presented to the Court in the claims estimation proceeding While AHRMA does not oppose the notion of mediation as a potential means of ultimate settlement with Team Obsolete it opposed the motion because of the additional time and costs associated with mediation while simultaneously estimating the claims
