    been but are not actively serving as a judge of a district or circuit court and have served in the capacity of judge for at least six consecutive years 2 are admitted to the practice of law in Alabama 3 are an active member in good standing of the Alabama State Bar Association 4 are a resident of Alabama The case must be one over which the court in which the former judge served would have had subject matter and monetary jurisdiction Once parties have agreed that hiring a private judge will be helpful and have selected a judge from the roster then all parties to the action must file a written petition with the circuit clerk of the court in which the action is pending requesting a private judge and naming the selected judge The petition must be accompanied by a form signed by the private judge consenting to the appointment This petition may be filed contemporaneously with the filing of the action or at any time after the action has been filed but before the beginning of trial The filing fee is 100 The clerk of the court will forward the petition to the presiding judge of the circuit of the pending case who will enter an order granting the petition and appointing the private judge A trial by private judge is conducted without a jury The judge has the same powers as the judge of a circuit court and has judicial immunity All proceedings are of record are filed with the clerk of the circuit court and are made available to the public The Alabama Rules of Civil Procedure apply An appeal from an action or judgment of a private judge is taken in the same manner as any appeal from the circuit court of the county

    Facilitate discussion of assets and liabilities including property and businesses and spousal support if any Allow each party the opportunity to communicate his or her concerns to the other party Encourage the parties to explore alternative ways to resolve problems Help parties negotiate an agreement satisfying to both Encourage parents to use problem solving skills in the future to address issues and deal with conflict The Center pays mediators with the special designation divorce domestic relations to provide mediation to families at low to no cost To date we have handled 65 cases Learn more at alabamaadr org web publicinfo FamilyMediation Tags Family Mediation Category Family Mediation Posted on February 12th 2015 Family Mediation Program Parenting Divorce and Post Divorce Issues The Alabama Center for Dispute Resolution Inc offers a FREE family mediation program to help families with children fashion a parenting plan for the judge The Center will pay the cost of specially trained mediators to support the process Since 2013 ACDR has been expanding this program The Family Mediation program is a collaboration between the Center and the Supreme Court of Alabama Our goal is to help families with children and incomes under 85 000 fashion a parenting plan specific to their family to give to the judge The plan includes parenting time responsibilities support and other items the family may want The Center pays the mediators with the special designation divorce domestic relations signifying 40 hours of specialized training Mediators are also asked to give a small amount of pro bono time Highlighted in the December 2014 issue of Alabama Lawyer the program has proved successful We mediated 20 cases in 2013 22 in 2014 and in 2015 since October 1 2014 we already have 23 cases underway nine of which have arrived at agreements This program
