    Archive About Us APCD Council Leadership Team Our Sponsors News NASHP Convenes Gobeille State Work Group in Partnership with APCD Council NASHP Convenes Gobeille State Work Group in Partnership with APCD Council We are pleased to report that the National Academy for State Health Policy NASHP is working with the APCD Council to develop a strategy with states in response to the U S Supreme Court decision in Gobeille vs Liberty Mutual Insurance Company This strategy will include exploring the possible regulatory solutions at the federal level to address concerns about future data collection efforts in all payer claims databases NASHP has secured funding and we have developed a state based work group to jump start our efforts Our goal is to consider and propose policy approaches to resolve the issues created by the Gobeille decision and to work with the US Department of Labor DoL and others to reach a speedy resolution to maintain the integrity of APCDs Clearly an important step will be to continue our work focused on data standards and to determine what options are legally and practically viable to assure robust reporting from all payers while complying with the Supreme Court s ruling We will

    Team Our Sponsors News New York State Health Foundation Releases RFP Related to New Priority Area Empowering Health Care Consumers New York State Health Foundation Releases RFP Related to New Priority Area Empowering Health Care Consumers The New York State Health Foundation has released an RFP for its newest priority area Empowering Health Care Consumers Through this RFP the Foundation will fund ambitious large scale projects or studies that may as examples create new tools and resources for consumers make the health care system easier to navigate identify effects of consolidation or address systemic repeated problems Additional information about this opportunity is available at http nyshealthfoundation org grant seekers rfps empowering health care consumers in new york state Applicants may be from outside of New York State but the project or analysis must be specific to New York All applicants must first complete an online inquiry form which is due by May 17 2016 at 1 PM EST After reviewing all inquiries the Foundation will select applicants to submit a full proposal The deadline for the full proposal is July 26 2016 at 1 PM EST Interested organizations are encouraged to contact Foundation staff early in the process to discuss

  • APCD Council Key Activities Related to SCOTUS Gobeille v. Liberty Mutual Insurance Company Decision | APCD Council
    policy communities underscoring the importance of the role of APCDs in improving the health and health care of individuals and validating longstanding efforts by states to establish these important databases The APCD Council is disappointed that the decision went against the Green Mountain Care Board in Vermont but the significant attention to the issues since the ruling highlights the pressing need for APCDs in the current landscape and broad support for exploring options going forward State entities remain committed to supporting data driven decision making and to collecting data through the APCD to support transparency and transformation in health care While the Gobeille decision raises difficult questions states across the country are working closely with the carriers employers and policy makers to identify the best ways to support the ongoing needs of the data submitters and state entities To date key activities resulting from the decision include Reviewing the data submission requirements in states and how they are affected by the ruling While there are many plans covered by ERISA and therefore this ruling data from many plans are not impacted by this ruling Developing tools to communicate directly with employers to ensure that employer stakeholders understand the value of APCDs for improving the health of a state Employers have an important role ensuring that an APCD can be used to drive changes in the local health care environment that support the health of their employees In instances that an employer would like to opt out of submitting data to an APCD states are identifying the mechanisms for employers to communicate interest in opting out of the data submissions to the states Analyzing the options for alternatives to data collection authority offered in the Supreme Court s opinions and what pathways may exist to leverage those alternatives The Supreme Court

    the Gobeille v Liberty Mutual Case closely As many of you know NAHDO was a lead petitioner joined by the Council and CIVHC and others in an Amicus brief to the Supreme Court in support of the Vermont Green Mountain Care Board The Supreme Court of the United States SCOTUS decision in favor of Liberty Mutual was a disappointment SCOTUS decided that Liberty Mutual as a self insured employer can choose not to submit their health claims data to Vermont s all payer claims database The decision governs only claims data maintained by self insured employer health plans governed by ERISA However the APCD Council remains committed to assisting states in their efforts to improve the health of their populations through improved transparency and informed decision making as well as to support state health reform activities The APCD Council is carefully reviewing the SCOTUS opinions to better understand the implications and opportunities for states APCD data have been vital to many state efforts to support health care and payment reform efforts Even if self insured data is partially reported statewide APCDs provide information on covered populations not available elsewhere and will remain a key tool for state efforts in these
