  • Benefits of Mediation
    promotes Economical Decisions Mediation is generally less expensive when contrasted to the expense of litigation or other forms of fighting Rapid Settlements In an era when it may take as long as a year to get a court date and multiple years if a case is appealed the mediation alternative often provides a more timely way of resolving disputes When parties want to get on with business or their lives mediation may be desirable as a means of producing rapid results Mutually Satisfactory Outcomes Parties are generally more satisfied with solutions that have been mutually agreed upon as opposed to solutions that are imposed by a third party decision maker High Rate of Compliance Parties who have reached their own agreement in mediation are also generally more likely to follow through and comply with its terms than those whose resolution has been imposed by a third party decision maker Comprehensive and Customized Agreements Mediated settlements are able to address both legal and extra legal issues Mediated agreements often cover procedural and psychological issues that are not necessarily susceptible to legal determination The parties can tailor their settlement to their particular situation Greater Degree of Control and Predictability of Outcome Parties who negotiate their own settlements have more control over the outcome of their dispute Gains and losses are more predictable in a mediated settlement than they would be if a case is arbitrated or adjudicated Personal Empowerment People who negotiate their own settlements often feel more powerful than those who use surrogate advocates such as lawyers to represent them Mediation negotiations can provide a forum for learning about and exercising personal power or influence Preservation of an Ongoing Relationship or Termination of a Relationship in a More Amicable Way Many disputes occur in the context of relationships that will continue

    Research Evaluation State Information Systems Design Training Resources Part C Early Intervention CADRE Products State Dispute Resolution Resource Showcase Parent Dispute Resolution Resource Showcase CADRE Webinars Calendar This document does not offer formal policy guidance from the Office of Special Education Programs at the United States Department of Education Subscribe to The CADRE Caucus WHAT S CADRE CAUCUS Share CADRE Tweet This site is funded by Subscribe to CADRE s Practitioner List Serve WHAT S PRACTITIONER LIST SERVE Dispute Resolution Database Structure and Elements by Drs Howard and Judy Schrag Email this Print this Introduction The Individuals with Disabilities Education Act includes a number of procedural safeguards designed to protect the rights of parents and their child with a disability as well as give families and schools a mechanism for resolving disputes Procedures to handle disputes including complaints mediation requests and due process hearings have been developed by each state along with policies designed to insure the presence of the safeguards With policies and procedures in place most states developed tracking systems to ensure that alternative dispute resolution procedures were implemented and completed in a timely manner These tracking systems have been developed and maintained using a variety of media Many states started with paper files with most gradually moving toward the use of computer systems to maintain their records During 1999 CADRE in cooperation with NASDSE conducted a national screening of the current status of alternative dispute resolution data collection procedures carried out within the states Following the screening a more in depth study of state dispute resolution data collection procedures was conducted within ten states In general the sampled states have developed logging procedures within each formal dispute resolution process to follow the cases through the process However none of the ten sampled states had a case management

  • Evaluating the Fiscal Effectiveness of ADR Processes: Cost Benefit Analysis (CBA) - Return on Investment (ROI)
    resolutions that are reached in a timely manner user satisfaction with the process willingness to use an ADR process in the future if a disagreement occurs again and other measures of this kind Another evaluative measure accounts for the effective use of financial resources Given the high cost and high stakes decision making involved in disagreements in the area of special education it is appropriate to turn attention to the discussion of developing a fiscal capability model that demonstrates effective use of ADR procedures in both tangible and intangible returns on monies and resources invested by school districts parents and others Cost Benefit Analysis Return on Investment Health Care Education Associates of Dana Point California describe cost benefit analysis as an accounting process that compares money spent with the revenues that money produces or allows the organization to save Return on investment calculates the results of an intervention in financial terms One factor to consider when developing dispute prevention and resolution programs is that ADR processes are an investment This investment has returned value in the form of user satisfaction and the appropriate provision of special education and related services Another factor to determine is the extent that ADR processes have returned a financial worth Evaluation of ADR procedures at times relies on the reflections and results of those who have received training or have made use of an ADR process such as mediation or early neutral evaluation These results can help determine whether or not the ADR process was useful User evaluation measures can include whether or not the parties reached resolution the fairness of the ADR process and overall satisfaction In the area of ADR training typical evaluation indicators may show whether recipients enjoyed the training the ease and use of instructional material by the instructors and whether
