    The Michigan Special Education Mediation Program MSEMP provides services through the Community Dispute Resolution Program CDRP a statewide network of twenty conflict resolution centers with staff facilitators and volunteer mediators trained by the MSEMP The Michigan Department of Education Office of Special Education and Early Intervention Services support this approach through a grant to Dispute Resolution Education Resources Inc a Lansing based nonprofit organization to manage this federally funded dispute resolution program When a request for mediation is made it is routed to the appropriate local MSEMP center Trained intake staff at each center explain the dispute resolution options available under the IDEA and schedule a mediation session if desired The specialist explains how mediation and facilitation work in special education provides tips on preparing for a mediation session and refers parents to advocate services where appropriate Centers are required to assign mediators on an impartial basis although the parties can agree on a mediator from the MSEMP roster MSEMP also helps parents and educators discuss and resolve issues relating to Individualized Family Service Plans IFSPs Individualized Education Programs IEPs and resolution sessions Oklahoma s Special Education Mediation System Oklahoma provides special education mediation services through the Special Education Resolution Center SERC housed at Oklahoma State University Following SERC s success with managing other aspects of the dispute resolution system particularly the facilitation of resolution meetings SERC was awarded the contract to provide mediation services under IDEA SERC manages five highly trained mediators who are independent contractors to assist with disputes which develop at any time during the relationship of the parties over special education issues SERC provides ongoing training each year to assist mediators in sharpening their skills for overcoming roadblocks to settlement Mediators are invited to attend national conferences related to their duties in conducting mediation and facilitation

    to resolve differences before the SEA fully investigates a complaint Accordingly the State encourages local resolution through IEP facilitation the AEA Resolution Facilitator Process or Mediation if the LEA AEA and the complainant agree to use such an option Encouraging Early Resolution of Complaint Filings As soon as possible after the Bureau receives a Written State Complaint the assigned State staff member contacts the complainant to explore whether the person is aware of what the complaint process entails and whether another dispute resolution option would be acceptable and explains the available alternative processes The Bureau sends a letter to the LEA and the Area Education Agency and a copy to the complainant encouraging resolution of the identified concerns within 15 30 days Wisconsin Complaints System Staffing The Wisconsin complaints system workgroup membership has been quite stable The most senior person investigating complaints has 14 years of experience the most recently assigned person has two years of experience and the other four staff people have over four years each Complaint investigators provide technical assistance to LEAs to ensure corrective actions are completed and noncompliance is corrected within one year of identification Tracking Complaint Timelines The complaint coordinator oversees the progress of all complaints to ensure that timelines are followed The complaint workgroup meets on a weekly basis to assign complaints review complaint decision due dates review due dates for LEA correction of noncompliance and discuss investigations in progress Each complaint investigator receives a copy of a calendar indicating when decisions are due The calendar covers a two month period and enables timely review while staff are in the office Finally investigators are notified 10 months after decisions requiring corrective action to ensure that all corrective actions have been completed within one year of the finding of noncompliance Quality Control of Complaint
