    to clarify rights and its language may be more stringent than laws relating to the keeping of animals by persons with disabilities However important to note is that under current law people of all ages may be able to have service or emotional support animals with appropriate documentation and that people of all ages including those without a disability may be able to keep their pets despite no pet lease clauses if for example the owner did not commence a legal proceeding in a timely manner See below for the text of NYC s pets in housing law Int 494 Provides that is an unlawful to discriminate in housing and public accommodations against persons accompanied by a police dog This legislation was introduced because of concern that police officers in the K 9 unit who are required to live with their police work dogs have been threatened with eviction or denied occupancy in housing because of their police work dogs NYC Pets in Housing Law NYC Administrative Code 27 2009 1 Rights and responsibilities of owners and tenants in relation to pets a Legislative declaration The council hereby finds that the enforcement of covenants contained in multiple dwelling leases which prohibit the harboring of household pets has led to widespread abuses by building owners or their agents who knowing that a tenant has a pet for an extended period of time seek to evict the tenant and or his or her pet often for reasons unrelated to the creation of a nuisance Because household pets are kept for reasons of safety and companionship and under the existence of a continuing housing emergency it is necessary to protect pet owners from retaliatory eviction and to safeguard the health safety and welfare of tenants who harbor pets under the circumstances provided herein
