    standards for transactions code sets identifiers security and privacy of personal health information Before joining Anakam Braithwaite served as Chief Medical Officer of the eHealth Initiative and its Foundation providing clinical and technical insight for its programmatic and evaluation activities He also staffed the President s Information Technology Advisory Committee PITAC to help produce the June 2004 report Revolutionizing Health Care Through Information Technology He serves as Policy Committee Co chair and member of the Steering Committee of the Markle Foundation s Connecting for Health Project and as a Board member of Health Level Seven HL7 Braithwaite contributed to the Markle Common Framework for Networked Personal Health Information William F Jessee MD William Jessee MD FACMPE was most recently the President and Chief Executive Officer of the Medical Group Management Association MGMA His background includes medical training in pediatrics and preventive medicine Before joining MGMA in 1999 he served as Vice President for quality and managed care standards at the American Medical Association During his tenure at MGMA Jessee was an active board member for several organizations including the Commission on Accreditation of Healthcare Management Education CAHME the e Health Initiative e HI and the Colorado Regional Health Information Organization CORHIO He also served for nine years on the board of Exempla Healthcare in Denver including service as Chairman for two years Jessee contributed to the Markle Connecting for Health Common Framework for Networked Personal Health Information Wendy Angst Wesley Rishel Wes Rishel is a vice president in Gartner s healthcare provider research practice He covers interoperability health information exchanges HIE the U S nationwide health information network NHIN and the underlying technologies of healthcare IT including application integration and standards Mr Rishel is a commissioner of the Certification Commission for Healthcare Information Technology He served as a member of the Healthcare Information Technology Advisory Panel of the Joint Commission on Accreditation of Healthcare Organizations He was also one of the technical leads and a member of the steering group for the Connecting for Health program on regional health information networks He was the founding technical chair of Health Level Seven served as its chair in 2002 2003 and continues on the board He has served on the boards of directors of the Workgroup for Electronic Data Interchange WEDI the Healthcare Information Management Systems Society HIMSS and the eHealth Initiative eHI He was the primary author of the Gartner report summarizing the NHIN Prototype Architecture contracts of the Office of the National Coordinator ONC for Health IT Tony Trenkle Thomas G Morrison Thomas G Morrison co founded NaviNet America s largest health care communications network and is credited as the visionary thinker behind NaviNet s innovative solutions for unified patient information management UPIM As Chief Strategy Officer and Executive Vice President of Government Affairs at NaviNet he provides leadership for product and market strategies and consults with influencers in Washington DC as they work to reshape the health care system Morrison s health care experience includes senior management roles with

    must work together to assure trusted information sharing Ensure that Policy Guides Technology Policy goals must shape technology choices including standards and architecture and not vice versa Stimulate Innovative Models for Protecting and Sharing Information Public investments should support and encourage innovative models to achieve our health goals and protect information Implementing a Trusted Health Information Exchange Keynote speech which discusses Markle s mission programs and values the context of the current US health care the disruptive power of information technology Connecting for Health and the Common Framework the launch of Resources for Implementing Private and Secure Health Information Exchange and nine privacy protection principles Comments on FTC Breach Notification Rulemaking Section 13407 of the American Recovery and Reinvestment Act of 2009 ARRA 1 establishes temporary breach notification requirements for vendors of personal health records PHRs 2 and other entities not covered by the Health Insurance Portability and Accountability Act HIPAA and grants the FTC authority to issue interim final regulations governing these entities Similarly Section 13402 of ARRA imposes a new duty on entities covered by HIPAA and their business associates to provide notification to individuals when there has been a breach of unsecured protected health information PHI This latter provision applies to all PHI maintained by covered entities or their business associates including information in PHRs With respect to both of these provisions the term unsecured protected health information refers to PHI that is not secured through the use of a technology or methodology specified by the Department of Health and Human Services HHS in guidance as rendering the information unusable unreadable or indecipherable to unauthorized individuals 3 HHS has recently issued guidance on this issue the HHS Guidance on which we have submitted separate comments 4 Simultaneous with the issuance of the HHS Guidance HHS published a request for information RFI in advance of its rulemaking to implement the breach notification provisions that apply to HIPAA covered entities and their business associates We have also submitted comments on the RFI 5 The breach notification provisions in ARRA accomplish two important goals First they provide for individuals to receive notice in certain circumstances when their health information is at risk Second they create a powerful incentive for custodians of personal health information to adopt strong privacy and security practices in order to avoid a breach It is important to recognize the interaction of the rulemaking process being undertaken by FTC and HHS FTC will promulgate breach notification rules that apply to PHR vendors and related entities Breach notification rules promulgated by HHS will apply to HIPAA covered entities or business associates of such entities However the rules to be issued by both HHS and FTC will set breach notification standards for PHRs To avoid creating confusion for consumers it is critical that PHRs be subject to consistent rules governing how they store and share consumer data Our comments below are mainly directed at achieving this consistent regulatory framework We understand this issue will be broadly addressed in the
