    centers mediators and facilitators who work with corporate and government clients attorneys who offer mediation as an option to clients engaged in disputes about issues ranging from custody to business contracts administrators of programs offering specialized dispute resolution services such as special education mediation and people involved in research on conflict management PCM s Role in the Dispute Resolution Field A History of Accomplishments In 1993 PCM partnered with the Pennsylvania Bar Association to develop and pass legislation granting mediators a confidentiality privilege comparable to that enjoyed by social workers clergy and psychiatrists This was an important step in protecting a cornerstone of the mediation process PCM has led the discussion on credentialing for mediators in Pennsylvania With both a national debate on the merits and cautions on this issue as well as the increasing appearance of definitions of mediation in legislation and court rules PCM has hosted dialogue among interested stakeholders in the field and developed its own voluntary guidelines on credentialing best practices and ethics Plans for the Future PCM will continue to monitor legislative initiatives and collaborate with the Pennsylvania Bar and other conflict resolution organizations seeking ways to make Pennsylvania more hospitable to mediation as a way of resolving disputes Organization and Structure PCM brings together individuals from across the state who share a common interest in mediation as an alternative form of dispute resolution The work of PCM is carried out by standing and ad hoc committees with overall policy and direction set by the Board of Directors Our Mission The Pennsylvania Council of Mediators brings together individuals and organizations that share a common interest in mediation as the preferred form of dispute resolution PCM strives to increase the use of mediation through Education Increasing the demand for qualified practitioners Providing a network for professional

    future such as Conflicts between business partners Issues with a neighbor Employment disputes Child custody arrangements Arrangements for the care of an elderly relative What to expect in a mediation Any party can request a mediation The mediator will contact the other parties explain the mediation process and invite them to participate in the mediation Participation is voluntary and anyone may end their participation at any point if they feel continuing would not be useful At the mediation the mediator will explain the process and invite the parties to present their views The mediator and parties may develop ground rules to guide their discussions All discussions with the mediator before and during the mediation are confidential During the mediation participants may request a separate meeting with the mediator Discussions during these separate meetings are confidential unless the party wishes to bring information back to the table By summarizing and reframing the issues the mediator frequently helps the parties prioritize their importance and decide where they need to direct their energies Measuring the success of a mediation can be difficult Often participants come away feeling the mediation has met their needs simply because it allowed them an opportunity to air their issues be heard and learn more about the other parties perspective In many cases the participants decide that they want to formalize an agreement In this case the mediator may help the parties write it down in their own words Selecting an Appropriate Mediator Pennsylvania does not license mediators however there are many practicing mediators who meet qualifications established by local and national organizations and programs It is best to interview several mediators who work with the type of dispute you are seeking to resolve Check out the Before You Choose page under the Find a Mediator tab for additional

    include multiple opportunities to practice skills in role plays and other exercises Training is often offered by non profit community mediation centers and you may also find training presented by experienced mediators who are brought into the area by a sponsoring organization Basic mediation is just that basic If you plan to act as a mediator in some specialized area such as divorce and custody elder issues environmental etc you may need to take advanced training Training in specialized areas is also offered by both community mediation centers as well as professional groups A good mediator combines a balance of skills in the techniques and a manner that conveys neutrality and builds trust with clients While training gives a good start to learning how to be a mediator experience is what helps a mediator develop skills and establish comfort with his her approach to dealing with conflict People often expect to start getting this experience by observing a mediation or acting as a junior or co mediator with an experienced mediator As desirable as this is it is often difficult to find these opportunities The requirement for complete confidentiality in mediation may be a barrier to others observing however if the parties agree observers may be present as long as the observers agree to the same confidentiality requirements as the mediator There are limited settings where one can serve as a co mediator Community mediation centers usually require mediators in training to get experience by observing or participating as a co mediator in several mediations The reality is that these centers often have more volunteer mediators than they have cases calling for mediators Individual practitioners have very limited situations where trainees can observe or participate in a mediation Certification There is currently no national or statewide organization that certifies or licenses mediators in Pennsylvania Many times a mediator may state that s he is a certified mediator That usually means that whatever person or organization trained them provided them with some certification of having completed their training There are a number of local court systems in Pennsylvania that offer mediation as an option to litigation in a variety of situations custody and divorce small claims civil suits etc These individual courts have established their own criteria for listing a mediator as a member of their roster If you plan to try to mediate in such court settings it is best to contact that court to determine their requirements Working as a Mediator If the point of getting trained is to make a living as a mediator you need to understand the state of the field as far as employment opportunities are concerned For all the explosion of interest in using mediation in a vast array of settings there are few people who are able to make a living acting solely as a mediator People who take mediation training tend to have one of three primary goals in mind become a volunteer as in unpaid at a community mediation center enhance

    Knowledge base Acquire sufficient subject knowledge to facilitate communication develop and explore options and consequences and make parties aware of any information relevant to their decision making Be knowledgeable of available community resources and referral sources Ethical standards Adherence to ethical standards as established by PCM Be familiar with commonly encountered ethical dilemmas Conduct of the mediator Identify and separate personal values from issues under consideration Maintain a calm presence Be flexible Use clear language in speaking and writing When co mediating keep the other mediator s informed of developments essential to an effective collaborative effort Treatment of participants Demonstrate respect for all participants Be aware of and sensitive to parties values gender ethnic cultural and lifestyle differences Undertaking the process Demonstrate respect for the process Explain the mediation process to the parties including The role of the mediator The parties options within the process Confidentiality The possibility of separate sessions caucuses Determine that all the appropriate parties are present for the mediation Determine if the presence of other persons and or counsel for one or more parties will benefit the mediation process and accept any other person s and or counsel to be present if all parties agree Explain that the mediator or any party may terminate the mediation at any time Explain alternative processes potentially available to resolve disputes Screen for the appropriateness of the parties to participate in mediation i e abuse potential for violence substance abuse mental health issues Offer the parties the option of undertaking the mediation with the mediator or selecting another mediator Secure verbal or written agreement to mediate Encourage the parties where appropriate to seek other professional advice before during and after the mediation process During the process Facilitate a process for participants to determine their own appropriate decisions including creative options

    to complete an initial apprenticeship and take a certain number of continuing mediation education hours each year to remain on the roster In the absence of licensing or certification your mediator s affiliation and or active participation in a professional organization may be some indication of his or her qualifications ability and commitment to the practice of mediation The leading professional organizations in Pennsylvania are the Pennsylvania Council of Mediators PCM and the Alternative Dispute Section of the state and local Bars Nationally the primary organizations mediators belong to are the Association for Conflict Resolution ACR the Victim Offender Mediation Association VOMA and the National Association for Community Mediation NAFCM Mediation Experience Don t assume that because someone says s he is a mediator that s he has actual mediation experience Completing a mediator training program does not demonstrate that an individual is qualified to mediate every dispute Unless a newly trained mediator is willing to volunteer for a court based program or community mediation center those who take mediator training may have a difficult time actually being selected to mediate a case Most private mediation services require at least some experience before adding a mediator to their roster To be safe ask your prospective mediator how many cases s he has mediated Because of confidentiality it will be difficult to get personal references outside those agencies that administer special rosters Speaking with respected colleagues is also a great way to find a good mediator Mediation Styles When selecting a mediator you may benefit from exploring the various mediator styles and choosing a mediator who practices a style that fits your needs Three basic mediator styles are widely used evaluative facilitative and transformative Evaluative Mediation Evaluative mediation looks more like a settlement conference in the legal arena The mediator is directive may give advice and may point out case weaknesses when asked Evaluative mediators are often selected because of their subject matter expertise The parties expect the mediator to evaluate their positions and advise them in regard to the settlement Some people feel that evaluation jeopardizes the mediator s neutrality because the assessment invariably favors one side over the other Facilitative Mediation Facilitative mediation is a process designed to help the parties move off of hardened positions and instead identify their underlying interests The mediator drives the process and the parties retain self determination over the resolution if they are able to reach one Facilitative mediators do not give advice or predict how a court might rule on the situation Some facilitative mediators will however contribute ideas during the brainstorming stage if the parties get stuck and will help the parties evaluate the options they brainstormed by asking reality testing questions Transformative Mediation Transformative mediation was introduced in the mid 1990s It is client driven Based on the ideals of empowerment and recognition the goal of transformative mediation is to increase the parties capacity to work things out by acknowledgment of and empathy toward the other This style emphasizes communication
