    Teton Basin Sand Creek Middle Henry s Fork Island Park Shotgun Valley Protected Lands to Date Summary Map of Easements Home Land Easements Defined What is a Conservation Easement A conservation easement is an agreement between a willing landowner and a qualified organization to restrict permanently the type and amount of development that takes place on his or her property The conservation easement prohibits development that would be harmful to the public benefits the easement seeks to protect for example wildlife habitat scenic views or important agricultural and ranching lands The landowner continues to own the property he or she may sell it live on it use it or leave it to heirs but the agreed upon restrictions remain with the land forever Granting a conservation easement does not mean that the landowner must grant public access to his or her property Conservation easements can result in income tax benefits and estate tax benefits if the land qualifies under IRS criteria While the tax benefits are helpful many people have found the greatest satisfaction in working with the Teton Regional Land Trust is the assurance that the land they cherish will always be protected The Teton Regional Land Trust cannot warrant that a tax benefit will arise from donation of a conservation easement and does not provide an estimate of potential tax benefits Trained professional appraisers perform calculations of donation value Landowners must consult with their legal and financial advisors Who can accept a conservation easement L and trusts or governmental entities A land trust is a nonprofit organization that as all or part of its mission actively works to conserve land by undertaking or assisting in land or conservation easement acquisition or by its stewardship of such land or easements The Teton Regional Land Trust is a non profit

    Teton Regional Land Trust and describes his or her long term plans for the property including planned building sites restoration projects and agricultural activities The landowner discusses these plans with his her tax advisor The Land Trust describes its policies how an easement works and other conservation options but does not provide financial and legal advice Title work The landowner provides a recent title report to the Land Trust A specific minerals report may be necessary if the landowner does not own the mineral rights The landowner must also secure subordination of property mortgages Board review A subset of the Land Trust s board the Conservation Committee reviews the proposed project to make sure it complies with the Land Trust mission and goals Drafting the Easement The Land Trust uses information provided by the landowner and additional resource information as needed to draft a conservation easement for the landowner and his her legal advisor to review The landowner and the Land Trust work together and with their legal advisors to negotiate easement terms that are acceptable to both parties Baseline Report The Land Trust conducts a baseline study of the property s historic and present land uses including agriculture man made features ecological features wildlife use and habitats soils hydrology geology and scenic values For landowners who claim income tax deductions for easement donations baseline data must be collected prior to the granting of the easement gift as an IRS requirement Appraisal of the Property The landowner hires a qualified appraiser to assess the economic value of the conservation easement and works with his her legal advisor and appraiser to ensure that the conservation easement complies with all federal regulations Final Board review The Conservation Committee and Board review an abstract of the easement terms project details and conservation ranking

    Chester Wetlands Teacher Trunks Nordic Naturalists Focal Areas Map of Focal Areas South Fork Lower Henry s Fork Teton Basin Sand Creek Middle Henry s Fork Island Park Shotgun Valley Protected Lands to Date Summary Map of Easements Home Land Criteria Easement Criteria What does the Land Trust consider when deciding whether to approve a conservation easement B efore approving a conservation easement the Board of Directors determines that the project meets the goals of the Trust that protection will provide a significant public benefit and that the Trust is capable of carrying out the perpetual stewardship obligations Lands must have significant value in one or more of the following categories Wetlands floodplains and riparian habitats necessary for the protection of water quality fish and wildlife Active ranching farming or other productive agricultural use providing significant open space values and conforming with local government interest in maintaining agricultural uses of the land Habitat for endangered threatened or rare species Important wildlife habitat or migratory routes Ecosystems that remain in relatively natural undisturbed conditions Historic lands or buildings Open space that s valuable to a community due to its proximity to developing areas or its prominent position in how people perceive
