for all veterans and active duty servicemen and women who may be a risk is a good move by secretary Nicholson and we commend him for it said VVA National President John Rowan Since the Secretary is seeking bids for this service the cost is still unclear However VVA is adamantly opposed to any further diminishment of VA health care and other vital services that are already under funded to pay for this While we share the Secretary s commitment that this must be paid for with added funds the Office of Management Budget OMB the President and Congress must move to find these additional funds Rowan said that Sec Nicholson s announcement is a good first step toward addressing one aspect of the issues uncovered by the data theft The questions of what the VA Policy Planning office was doing with confidential and privileged information on individual veterans and active duty service members still have not been addressed much less satisfactorily answered he said Questions have been raised as to whether they had legitimate reason to have Social Security data disability codes and percentages and other information about individuals in that office What work were they doing Since OMB

know what is accessible to anyone on these laptops reaffirms our reasons for having joined in the lawsuit to get court protection for veterans personal data as the VA obviously is incapable of securing this information on its own VA Secretary Nicholson is expected to publicly confirm the recall inventory of all VA laptops today in testimony before the Senate Committee on Homeland Security and Government Reform It is appalling that even though there is no concrete evidence that the files contained on the external hard drive of the stolen laptop have led to the theft of any veteran s identity the VA only now discovers that personal information on as many as 1 1 million military members on active duty 430 000 members of the National Guard and 645 000 members of the Reserves may have been included in the data theft This makes the theft all the more troubling because it potentially jeopardizes the well being and morale of our troops in the field by compromising the safety of their families here at home We appreciate the belated attempt on the part of VA leadership to provide veterans and the American public with truthful information about this theft

control of his department and we believe him However he has yet to answer some critical questions What was an employee of the VA doing with the names Social Security numbers and dates of birth of all these veterans the vast majority of whom have never availed themselves of VA services Why is the VA collecting this information in the first place VVA is joined by four other national organizations and individual veterans in the lawsuit which was filed in federal district court today by attorney Douglas Rosinski of the law firm Ogletree Deakins Nash Smoak Stewart P C They are the National Gulf War Resource Center Radiated Veterans of America Citizen Soldier and Veterans for Peace Saying We re sorry is hardly comforting to veterans and their families Rowan said The VA has been criticized for years about lax information security and that includes criticism from the VA s own Inspector General The VA still hasn t properly secured all the personal information under its control We ve just seen the largest known unauthorized disclosure of Social Security numbers in history We hope this lawsuit will help Secretary Nicholson correct the known vulnerabilities in how the VA protects private information If the VA can t solve the problem maybe the courts can help Since all previous attempts at protecting privacy of individual veterans by heads of the VA have failed perhaps the weight of the judiciary can make the difference This lawsuit seeks to insure that no harm will come to veterans as a result of this theft and that such an incident can never occur again The veterans complaint filed in the U S District Court for the District of Columbia seeks A declaratory judgment that the VA s loss of these records violated and continues to violate
